In his cross-examination, PW-1 stated that he has not put his signature in the column reserved for thumb impression/signature of complainant/informant in the printed form of FIR. He denied the defence suggestion that no GD was maintained before proceeding to the P.O. on the day of occurrence. He admitted that he has neither stated before the I.O. nor mentioned in the FIR that they found one Uttam Kalita selling teer ticket on the roadside. He seized three numbers of blank teer ticket book which were ascertained to be teer ticket from his previous experiences in handling such type of cases. In P.Ext3/PW-1 he has (100) not mentioned the details of pages and numbers of teer ticket. He denied the defence suggestion that he has not seized any teer ticket book from the possession of accused Uttam Kalita for which he has not mentioned the details of pages and numbers of teer ticket in the seizure list. They did not find any person purchasing teer ticket from Uttam Kalita. His statement that accused Uttam Kalita was selling teer ticket is based on assumption only. He admitted that he has neither stated before the I.O. nor mentioned in the FIR that they found accused Ajay Roy while he was going by his scooty. They arrested the accused Ajoy Roy (200) only on the basis of statement of accused Uttam Kalita. He further denied the defence suggestion that accused persons are not involved in selling of teer ticket and did not find any teer book from accused Uttam Kalita. He has not seen the seized teer book that day in the court. PW-2 is Jayanta Baishya, who deposed in his evidence that he does not know the informant as well as the accused persons. Around few months back on a certain day at day time he parked his auto rickshaw at Kumarpara Pachali. He saw the accused persons being lifted in a police vehicle. Police asked him to put his signature (300) on a paper. He exhibited the seizure list as P.Ext-3/PW-1 and identified his signature thereon as P.Ext-3(2)/PW-2.

PW-3 is Jikir Ali who deposed in his evidence deposed that he does not know the informant as well as the accused. Few years back on a certain day during day time while he was going towards his house he saw a gathering of people at Kumarpara. Accordingly, he stopped and police asked his name and address. He knows nothing about the case. PW-4 is Sri Prabhat Kalita who deposed in his evidence that he does not know the informant as well as the accused. Few years back on a certain day during day time while he was at his tea stall situated near Bharalumukh PS, Police (400) of Bharalumukh PS asked him to put his signature on a paper. He knows nothing about the case.
